Bases legales del Sorteo "La maleta de Ehlea"

Este concurso “La Maleta de Ehlea” se rige exclusivamente por las leyes de España.

Fechas de la competición: El Sorteo comienza a las 12:00 horas, hora española, del jueves 10 de agosto de 2023 y finaliza a las 15:00 horas, hora española, del jueves 24 de agosto de 2023.
La empresa creadora del Sorteo es Ehlea Moda S L U, con CIF, B10947067, inscrita en el Registro Mercantil de España, con domicilio social en Raval de Jesus 33 3 de Reus, Tarragona, que diseña y comercializa ropa y accesorios de gama premium para mujer.
Requisitos: El Sorteo está abierto a todos los usuarios de Instagram que residan dentro de la Unión Europea, que hayan alcanzado la mayoría de edad en su propio estado en la fecha de inscripción y tengan acceso a una conexión a Internet y una dirección de correo electrónico válida. Los directores y empleados de Ehlea, o sus filiales y empresas relacionadas, y los miembros de la familia inmediata (padres, hijos, hermanos, cónyuge) o miembros del mismo hogar (estén o no relacionados) de dichos directores y empleados no son elegibles para participar en el concurso.
En el momento de declarar al Ganador, Ehlea se reserva el derecho de pedir a cualquier Participante que justifique estas condiciones. Cualquier persona que no cumpla estas condiciones o se niegue a justificarlas será excluida del Sorteo y no podrá, en caso de resultar ganadora, beneficiarse del Premio. Del mismo modo, cualquier declaración, indicación de identidad o dirección falsa dará lugar a la eliminación inmediata del Participante.
El Sorteo está sujeto a todas las leyes y reglamentos españoles aplicables.

Aceptación del Reglamento: Al participar en el Sorteo, usted, el Participante, acepta total e incondicionalmente someterse a estas Reglas Oficiales y a las decisiones de Ehlea, que serán definitivas y vinculantes en todos los asuntos relacionados con el Concurso.
Cómo participar: Durante el Periodo del Sorteo, los Participantes deberán en Instagram:

dar “Me gusta” a la publicación del Sorteo en la cuenta @ehlea_official;
etiquetar en la publicación del Sorteo en la cuenta @ehlea_official a otro (1) usuario de Instagram. Se puede comentar la publicación tantas veces como se quiera mientras el usuario mencionado no se repita;
seguir la cuenta @ehlea_official
tener una cuenta pública.

Los Participantes deberán asegurarse previamente de contar con el consentimiento del usuario de Instagram etiquetado, antes de introducir sus datos personales (usuario de Instagram). Ehlea declina cualquier responsabilidad relacionada con dicha divulgación sin consentimiento.
Al participar en el Sorteo, el Participante acepta estas Reglas Oficiales.
No se tendrá en cuenta ninguna inscripción por teléfono, fax, correo postal o electrónico.

Premio: El Premio descrito a continuación se otorgará a un Ganador, que deberá ser Participante y que cumpla con los Términos y Condiciones de participación.El Premio consiste en un vale de Ehlea por valor de doscientos cincuenta euros (250€), impuestos incluidos, para utilizar en el sitio web www.ehlea.com. Las prendas elegidas por el Ganador del Sorteo están sujetas a su disponibilidad de stock.
El Premio es personal, no puede cambiarse ni reembolsarse en metálico y es válido durante el año 2023.
El Premio se concede “tal cual”, sin ninguna garantía expresa o implícita. El derecho a recibir el Premio no es transferible y no se permiten sustituciones ni equivalentes en metálico. Ehlea no sustituirá el Premio en caso de pérdida, robo o anulación del mismo. Todos y cada uno de los gastos relacionados con el Premio, incluidos, entre otros, todos y cada uno de los impuestos federales, estatales o locales serán responsabilidad exclusiva del Ganador.
Como consecuencia de la aceptación del Premio, el Ganador autoriza a Ehlea Moda S L U a utilizar su nombre, apellidos, ciudad de residencia, en todos los medios de comunicación conocidos o desconocidos hasta la fecha, en particular Internet y las redes sociales, sin que esta utilización pueda dar lugar a otra contrapartida que el Premio ganado, con el fin de promocionar los resultados del Sorteo.

Selección y notificación del ganador: Se seleccionará al azar un (1) Participante el jueves 24 de agosto de 2023 mediante una aplicación móvil a partir de la lista de Participantes que cumplan las condiciones mencionadas en el Artículo 5 del presente (en adelante, el “Ganador”). El Ganador seleccionado se anunciará tras el Periodo del Concurso en el pie de foto de la publicación de Instagram relativa al Concurso y en historias de Instagram.
El Ganador será notificado a través de un mensaje privado en Instagram. Si el Ganador: (i) no puede ser contactado; (ii) no responde en un plazo de siete (7) días a partir del día del intento de Ehlea de ponerse en contacto con el Ganador y/o (iii) rechaza el premio descrito en el Artículo 4, el Ganador pierde definitivamente el derecho a ganar y recibir el Premio, y se designará un Ganador sustituto. Tras ponerse en contacto con el Ganador y comprobar que cumple todos los términos y condiciones de participación en el Sorteo, en particular sometiéndose a cualquier comprobación adicional exigida por Ehlea, el Ganador será declarado definitivamente “Ganador” del Sorteo.
Tratamiento de datos personales y Política de Privacidad: Todos los datos personales recopilados por Ehlea son confidenciales y están sujetos a la Política de privacidad / tratamiento de datos personales disponible en www.ehlea.com.
Condiciones generales: Las decisiones tomadas por Ehlea son definitivas en todos los asuntos, incluyendo la interpretación de estas Reglas Oficiales y la adjudicación del Premio. Los participantes asumen todos los riesgos de pérdida, daño, destrucción, retraso o envío erróneo de los materiales del Sorteo enviados a Ehlea. Ehlea se reserva el derecho, a su entera discreción, de cancelar, finalizar, modificar o suspender el Sorteo, o cualquier parte del mismo, en caso de que cualquier virus, error, fallo técnico, intervención humana no autorizada, fraude o cualquier otra causa ajena al control de Ehlea afecte a la administración, seguridad, integridad o correcto funcionamiento del Sorteo, según determine Ehlea a su entera discreción.
Ehlea, a su entera discreción, se reserva el derecho de descalificar a cualquier Participante que considere que está manipulando o intentando manipular el proceso de participación o el funcionamiento del Sorteo o que esté actuando en contra de estas Reglas Oficiales. Cualquier intento por parte de un Participante de dañar o socavar deliberadamente el funcionamiento legítimo del Sorteo puede constituir una violación de las leyes penales y civiles y, en caso de que se produzca dicho intento, Ehlea se reserva el derecho a reclamar daños y perjuicios a cualquier Participante en la máxima medida permitida por la ley. Al participar en el Concurso, el Participante se compromete total e incondicionalmente a respetar todas las condiciones de uso de la página web de Instagram disponibles en https://help.instagram.com/.
Exoneración: Al participar en el Sorteo, los Participantes aceptan exonerar de responsabilidad y eximir de toda responsabilidad a Ehlea, su empresa matriz, filiales y empresas relacionadas, y a cada uno de sus respectivos directivos, directores y empleados y agentes de y contra cualquier reclamación o causa de acción, incluyendo, pero no limitado a, lesiones personales, muerte, o daños o pérdida de bienes, derivados de la participación en el Sorteo o de la recepción o uso o mal uso de cualquier Premio.
Limitación de responsabilidad: Ehlea no se hace responsable de: (1) cualquier información incorrecta o inexacta, ya sea causada por el Participante, errores de impresión, o cualquiera de los equipos o programación asociados o utilizados en el Sorteo; (2) fallos técnicos de cualquier tipo, incluyendo, pero no limitado a, mal funcionamiento, retrasos, interrupciones o desconexiones en las líneas telefónicas o hardware o software de red; (3) errores técnicos o humanos que puedan producirse en la administración del Sorteo o en el procesamiento de las inscripciones; (4) inscripciones tardías, perdidas, imposibles de entregar, dañadas, robadas, mal dirigidas o con franqueo vencido; o (5) cualquier lesión o daño a personas o bienes que pueda ser causado, directa o indirectamente, en su totalidad o en parte, por la participación del Participante en el Sorteo o la recepción o uso o mal uso de cualquier Premio.
Litigios: El presente Concurso se rige por la legislación de España, sin perjuicio de las doctrinas sobre conflicto de leyes. Como condición para participar en este Sorteo, el Participante acepta que todas y cada una de las causas de acción que se deriven o estén relacionadas con este Sorteo se resolverán individualmente, sin recurrir a ninguna forma de acción colectiva, exclusivamente ante un tribunal situado en España. Además, en ningún caso se permitirá al Participante obtener indemnizaciones por daños y perjuicios punitivos, incidentales o consecuentes, incluidos los honorarios razonables de los abogados, aparte de los gastos directos reales del Participante, y el Participante renuncia además a todo derecho a que se multipliquen o aumenten los daños y perjuicios.
Cualquier cuestión relativa a la aplicación o interpretación de las Reglas Oficiales, o cualquier cuestión imprevista que pueda surgir, será decidida por Ehlea a su entera discreción.
Nombre del Ganador y Reglas: Para obtener una copia del nombre del Ganador o una copia de estas Reglas Oficiales, envíe por correo su solicitud junto con un sobre franqueado y con su dirección a Ehlea Raval de Jesus 42 3 B 43201 Reus, Tarragona. Legal terms and conditions of the “Ehlea’s suitcase” prize

This competition “La Maleta de Ehlea” is governed exclusively by the laws of Spain.

Competition dates: The Sweepstakes starts at 12:00 noon Spanish time on Thursday 10 August 2023 and ends at 15:00 noon Spanish time on Thursday 24 August 2023.
The company creating the Prize Draw is Ehlea Moda S L U, with CIF, B10947067, registered in the Mercantile Register of Spain, with registered office at Raval de Jesus 33 3 in Reus, Tarragona, which designs and markets premium range clothing and accessories for women.
Eligibility: The Sweepstakes is open to all Instagram users residing within the European Union, who have reached the age of majority in their own state on the date of entry and have access to an internet connection and a valid email address. Directors and employees of Ehlea, or its subsidiaries and related companies, and members of the immediate family (parents, children, siblings, spouse) or members of the same household (whether related or not) of such directors and employees are not eligible to enter the competition.
At the time of declaring the Winner, Ehlea reserves the right to ask any Entrant to justify these conditions. Any person who does not comply with these conditions or refuses to justify them will be excluded from the Prize Draw and will not be eligible, in case of winning, to benefit from the Prize. Similarly, any false statement, indication of identity or address will result in the immediate elimination of the Participant.
The Prize Draw is subject to all applicable Spanish laws and regulations.
Acceptance of Rules: By entering the Prize Draw, you, the Entrant, fully and unconditionally agree to be bound by these Official Rules and the decisions of Ehlea, which shall be final and binding in all matters relating to the Prize Draw.
How to enter: During the Sweepstakes Period, Entrants must on Instagram:
– “Like” the Sweepstakes post on the @ehlea_official account;
– tag one (1) other Instagram user in the Sweepstakes post on the @ehlea_official account. You can comment on the post as many times as you like as long as the user mentioned is not repeated;
– follow the account @ehlea_official
– have a public account.
Participants must first ensure that they have the consent of the tagged Instagram user before entering their personal data (Instagram user). Ehlea disclaims any liability in connection with such disclosure without consent.
By entering the Sweepstakes, the Entrant agrees to these Official Rules.
No entries by phone, fax, mail or email will be considered.
Prize: The Prize described below will be awarded to one Winner, who must be an Entrant and who complies with the Terms and Conditions of participation. The Prize consists of an Ehlea voucher worth two hundred and fifty Euros (€250), inclusive of tax, to be used on the www.ehlea.com website. The garments chosen by the Winner of the Prize Draw are subject to stock availability.
The Prize is personal, cannot be exchanged or refunded in cash and is valid for the year 2023.
The Prize is awarded “as is”, without any express or implied warranty. Entitlement to the Prize is non-transferable and no substitutions or cash equivalents are permitted. Ehlea will not replace the Prize in the event of loss, theft or cancellation of the Prize. Any and all expenses related to the Prize, including but not limited to any and all federal, state or local taxes, shall be the sole responsibility of the Winner.
As a consequence of accepting the Prize, the Winner authorises Ehlea Moda S L U to use his/her name, surname, city of residence, in all media known or unknown to date, in particular the Internet and social networks, without this use giving rise to any consideration other than the Prize won, for the purpose of promoting the results of the Sweepstakes.
Selection and notification of the Winner: One (1) Participant will be selected at random on Thursday 24 August 2023 via a mobile application from the list of Participants fulfilling the conditions mentioned in Article 5 hereof (hereinafter referred to as the “Winner”). The selected Winner will be announced after the Contest Period in the caption of the Instagram post relating to the Contest and on Instagram stories.
The Winner will be notified via a private message on Instagram. If the Winner: (i) cannot be contacted; (ii) does not respond within seven (7) days from the day of Ehlea’s attempt to contact the Winner and/or (iii) rejects the prize described in Article 4, the Winner definitively loses the right to win and receive the Prize, and a substitute Winner will be designated. After contacting the Winner and verifying that he/she complies with all terms and conditions of participation in the Prize Draw, in particular by submitting to any additional checks required by Ehlea, the Winner will be definitively declared the “Winner” of the Prize Draw.
Processing of personal data and Privacy Policy: All personal data collected by Ehlea is confidential and subject to the Privacy Policy / processing of personal data available at www.ehlea.com.
General Conditions: Decisions made by Ehlea are final in all matters, including the interpretation of these Official Rules and the awarding of the Prize. Entrants assume all risk of loss, damage, destruction, delay or misdirection of Sweepstakes materials submitted to Ehlea. Ehlea reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes, or any part thereof, in the event that any virus, bugs, technical failure, unauthorized human intervention, fraud or any other cause beyond Ehlea’s control affects the administration, security, integrity or proper operation of the Sweepstakes, as determined by Ehlea in its sole discretion.
Ehlea, in its sole discretion, reserves the right to disqualify any Entrant who it believes is tampering or attempting to tamper with the entry process or the operation of the Sweepstakes or who is acting contrary to these Official Rules. Release: By entering the Sweepstakes, Entrants agree to release and hold harmless Ehlea, its parent company, affiliates and related companies, and each of their respective officers, directors and employees and agents from and against any and all claims or causes of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use or misuse of any Prize.
Limitation of Liability: Ehlea is not responsible for: (1) any incorrect or inaccurate information, whether caused by the Entrant, printing errors, or any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to, malfunctions, delays, interruptions or disconnections in telephone lines or network hardware or software; (3) technical or human error that may occur in the administration of the Sweepstakes or in the processing of entries; (4) late, lost, undeliverable, damaged, stolen, misdirected or postage-due entries; or (5) any injury or damage to persons or property that may be caused, directly or indirectly, in whole or in part, by Entrant’s participation in the Sweepstakes or receipt or use or misuse of any Prize.
Litigation: This Prize Draw is governed by the laws of Spain, without prejudice to its conflict of laws doctrines.
